Below is an extract of the manufacturer’s warranty. If you want to make a claim under their warranty, please contact us in the first instance and we will contact the manufacturer on your behalf. Please provide us with your name, address and contact details, when you bought the product from us and what the fault is, together with pictures.
At Dagger, they’re proud to manufacture some of the highest quality kayaks in the world. They are guaranteed for 3 years from the date of purchase.
The Seller warrants in favour only of the original retail purchaser (“Consumer”) that the hull, deck, outfitting and all parts and accessories of all Dagger & Islander Kayak products shall for 12 months from the date of consumer purchase (the “first warranty period”) (and subject to the exceptions set out below):
(a) Conform in all material respects with their description and any applicable specification (b) Be free from material defects in [design,] material and workmanship (c) Be of satisfactory quality (within the meaning of the Sale of Goods Act 1979)
If the Consumer gives notice in writing to the Seller during the first warranty period within a reasonable time of discovery that some or all of the goods do not comply with the warranty set out above and the Seller (or its authorised distributor) has been given a reasonable opportunity of examining the goods, and the goods have been sent to Palm or their authorised distributors (carriage/freight prepaid) then the Seller will at its option repair or replace the defective goods (or defective part) or refund the retail price of the defective goods in full.
The Seller further warrants in favour only of the Consumer that the hull and deck of all Dagger & Islander Kayak products shall for a further period of 12 months commencing on the first anniversary of the date of Consumer purchase (the “second warranty period”) (and subject to the exceptions set out below) be free from material defects in material and workmanship. If the Consumer gives notice in writing to the Seller during the second warranty period within a reasonable time of discovery that some or all of the goods do not comply with the warranty set out above and the Seller (or its authorised distributor) has been given a reasonable opportunity of examining the goods, and the goods have been sent to Palm or their authorised distributors (carriage/freight prepaid) then the Seller will at its option repair or replace the defective goods (or defective part) or refund 80% of the retail price of the defective goods.
The Seller further warrants in favour only of the Consumer that the hull and deck of all Dagger & Islander Kayak products shall for a further period of 12 months commencing on the expiry of the second warranty period (the “third warranty period”) (and subject to the exceptions set out below) be free from material defects in material and workmanship. If the Consumer gives notice in writing to the Seller during the third warranty period within a reasonable time of discovery that some or all of the goods do not comply with the warranty set out above and the Seller (or its authorised distributor) has been given a reasonable opportunity of examining the goods, and the goods have been sent to Palm or their authorised distributors (carriage/freight prepaid) then the Seller will at its option repair or replace the defective goods (or defective part) or refund 50% of the then current manufacturers’ recommended retail price (‘MSRP’) including VAT, of the defective goods. If sending the product to Palm or their authorised distributors the Consumer must enclose the original invoice/receipt number, boat number, date of purchase, the receipt for the return carriage/freight cost, the Consumer’s name, address and telephone number.
The Seller shall not be liable for goods’ failure to comply with any of the above warranties if: (a) The Consumer makes any further use of such goods after giving notice to the Seller of non-compliance with the warranty (b)The defect arises because the Consumer failed to follow the Seller’s oral or written instructions as to the storage, commissioning, installation, use and maintenance of the goods (c) The Consumer alters or repairs such goods without the written consent of the Seller (d) The defect arises as a result of fair wear and tear, willful damage, alteration, unauthorised repair, negligence, or abnormal storage
Dagger Kayaks products purchased for Professional or Commercial Use including demos and for hire only benefit from the warranties applying during the first warranty period. Dagger & Islander Kayaks stamped “Limited Warranty” only benefit from warranties applying during the first warranty period.
Except as set out in these Conditions, all warranties, conditions and other terms implied by statute or common law are, to the fullest extent permitted by law, excluded from the Contract.
Warranty and repair work: please allow up to 15 working days; in some cases this may be extended.
